Lenah Run Board Violates Law?

This is an email I received from Al Artz regarding the legal opinion provided by our Association Attorney that Lenah Run Board actions violated law:

From: Al Artz
To: Lenah Run Board
CC: Virginia Hayes PMP

I just spoke with Elizabeth Crego, our attorney and here's the story. Tom is correct. Furthermore she said in order to be in compliance, we can't even get together to discuss any HOA business as a group without it being open to the residents. So, bottom line, this meeting will need to be cancelled and we will need to get a date soon at the firehouse, do a mailing to the residents, arriving at least 3 days before the meeting, announcing the meeting for the purpose of formulating the preliminary budget, have the chairs present their budget to us there to discuss and for any residents who attend to observe. We need to take minutes and record any actions taken.

This action should also be taken by the committees to be in compliance. I think CC is OK, since they just had their meeting and agreed that they just needed expense money for paper, ink, etc. We are going to have to address the social committee with requirements they need to meet to be compliant with the By-Laws. Not sure how to handle it this time, but I think they could get a unanimous vote of acceptance of their budget by email and then at their next meeting, vote on it and put in the minutes. Not sure though that they will get a unanimous vote on it.

I had thought this could be treated like the organizational meeting we have with the new board members, but Elizabeth said that even that should technically be announced and open to members to attend. All of this law on volunteers makes it real tough folks, but we have no choice. Fun and games.

Virginia, can you check on a date for the firehouse for early next week and once firm, we need to put the notice out to all residents. Email won't work because we do not have everyone's email and posting notice at front to check the website won't work, because it does not guarantee coverage.
Regards,
Al

The above email was sent by Al Artz, the Lenah Run Association President, to Board Members after I raised an objection to their actions. In the recent Lenah Run Communicator, which I had no idea was even being put together, the "Board" indicates that the "integrity" of the board had been attacked. I will let you come to your own conclusion. There were several such meetings and since this incident, members of the Board have used other means to circumvent legal requirements.

Patty has been helping me take care of my two girls for 6 years now and she has become part of our family. Since my girls will be in school during the day, Patty is hoping to help other families this year. She'll continue to take care of our two girls after school, but is available most of the day starting at 7:30am.

She is wonderful with kids, building a really close bond with each one as an individual. Patty lives in Stone Ridge with her husband and two kids who attend Mercer Middle School; she is originally from Peru where she practiced family law. I share all of this with you to assure you that she is family-oriented, motivated, very smart, has a great work ethic, and most of all, has great moral character.

If you (or know of others) who would like help with the kids this year, please feel free to contact Patty Rivas-Plata on cell at 703-296-1414. Thank you.
